Hereafter, 'Customer' refers to any individual, corporation - or agent or officer thereof, or other entity or agent or officer thereof, designated in rental agreements, invoices, billing statements, or other documents related to this agreement.
1. Customer agrees to notify National Tool Leasing, LLC immediately if equipment provided was not received in good working condition. National Tool Leasing, LLC may at their discretion replace defective equipment or cancel rental agreement and request return of equipment. National Tool Leasing, LLC is not liable for any other costs incurred by the Customer caused by the delivery of defective equipment, or cancellation of rental agreement.
2. National Tool Leasing, LLC is not liable for any costs incurred by the Customer caused by the late delivery of rental equipment, or delivery of defective or incorrect equipment.
3. Customer agrees to return equipment in the same condition, and agrees to return all items clean to avoid additional charges.
4. Customer assumes all responsibility for injuries to persons or damages to property and agrees to hold National Tool Leasing, LLC harmless for any and all claims arising out of the use of rental equipment.
5. Customer agrees to National Tool Leasing, LLC's rights to enter premises of customer or jobsite at any time to repossess said equipment. Customer hereby waives any rights of action against owner by reason of such taking or entry, and agrees to reimburse National Tool Leasing, LLC's costs of repossession, if any.
6. Customer agrees to pay prevailing attorneys fees, collection fees, court costs, and any other expenses incurred in collecting any charges under this agreement, in taking the rented equipment, or otherwise enforcing the terms of this contract.
7. Customer agrees not to loan, sublet, or otherwise dispose of equipment or use it at any other location than listed as the Shipping Address in this agreement, and only as the manufacturer has intended.
8. Customer agrees to pay National Tool Leasing, LLC upon demand:
1. All rates, charges, taxes, delivery, pickup, and reservation or cancellation fees and all other amounts incurred as a result of this rental transaction.
2. Replacement fees for any loss or disappearance of equipment due to theft, conversion, or other dishonest acts on the part of any person to whom the property is entrusted, or any person in the service or employment of the lessee whether or not occurring during the hours of such service or employment. National Tool Leasing, LLC reserves the right to consider the property lost, stolen, or converted if not in the custody of National Tool Leasing, LLC or it's designee within 72 hours of the original return date.
9. Customer authorizes that National Tool Leasing, LLC may bill customer's credit card at the time of rental or any time during or after the rental.
10. If customer has directed, and National Tool Leasing, LLC has agreed, to bill charges to a third party who fails to make payment promptly when due, Customer promises to pay National Tool Leasing, LLC upon demand.
11. Customer understands that all rentals are subject to a final audit. Equipment received back into the possession of National Tool Leasing, LLC will be subject to inspection and evaluation of condition. Customer agrees that any additional charges resulting from such inspection and determination of condition can be made to the original payment method.
12. Extension of the original rental period can only be granted via written confirmation from National Tool Leasing, LLC and must be requested no less than 24 hours prior to the original period end date.
13. National Tool Leasing, LLC may quote additional rates such as weekly or monthly rates as a courtesy for longer term rentals. The item(s) rented can be rented on a daily basis. Therefore if rental equipment is not in the custody of National Tool Leasing, LLC or its designee within 72 hours of the original return date, National Tool Leasing, LLC reserves the right to recalculate the charges using only the daily rates. This rate may also be applied to any continuation or extension of the original rental period, unless a new agreement is made.
14. Customer agrees to pay full replacement and repair costs including parts, labor, shipping, or other costs associated with damage to the equipment which occurred during the term of this agreement. National Tool Leasing, LLC may also apply additional rental rates for loss of use of the item(s) for a period of up to 30 days.
15. Acceptance of the item(s) covered in this agreement show implied acceptance of this contract and its terms.
